As you know, on 10/11/09 California passed a very restrictive modification law called SB94. California brokers and all out of state brokers are now prevented from handling modifications directly with homeowners and in particular cannot accept upfront payment for future services.
Our attorney believes this law will not allow anyone to just help a homeowner with the modification paper work and collect a fee for that service even if the fee is paid after completion of the work.
SB94 does not apply to attorneys that are suing lenders nor to you when you become an expert witness. Your involvement in this program doesn’t fall under DRE oversight.
We work with a major California law firm that will sue a lender on behalf of a troubled California property owner facing foreclosure, if there is just cause. The standard fee is only $2795.00 plus $500.00 a month until the case is resolved.
Your opportunity is to find troubled homeowners with an NOD filed and then do a review of their financial information so we do not burden the attorneys with an impossible mission and if the file makes financial sense then it is time for you to make sure the borrower calls the attorney. Once the homeowner calls the attorney your job is done! Note, the homeowner must make the first call to the attorney as attorneys can not initiate contact with a potential client.
In many cases you might actually dial the attorney’s number and hand the phone to the potential client. If an attorney is not available; have the client leave a message for the attorney stating the best number and time to be reached.
An Attorney will interview the homeowner and will request financial information, copies of the complete loan file and the history of contact between the borrower and their lender.
We will be retained by the law firm to do a detailed financial review of the homeowner's ability to pay and their lender's current underwriting requirements for both the government HAMP program and the more traditional modification; non government programs that are often better options.
If the Attorney is retained by that homeowner, you will be paid $1000.00 in approximately 14 to 21 days by our corporation for your important analytical review of the homeowner's current financial condition.
